Welcome to PolyFund. By using our platform, you agree to these Terms of Service. Please read them carefully before making or receiving political contributions.
Acceptance of Terms
By accessing or using PolyFund, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable federal and state election laws. If you do not agree, do not use our platform.
Eligibility
To use PolyFund, you must:
- Be at least 18 years old
- Be a United States citizen or lawful permanent resident
- Not be a foreign national (federal law prohibits foreign national contributions)
- Complete identity verification through our KYC process
- Provide accurate and truthful information
Candidates must be registered with the FEC or applicable state election authority and comply with all campaign finance regulations.
Platform Services
PolyFund provides:
- A platform for donors to contribute USDC to verified political campaigns
- Identity verification and US residency confirmation via Coinbase
- Smart contract-based donation routing on Base blockchain
- Campaign dashboards for candidates to track contributions
- FEC-compliant reporting and record-keeping tools
User Accounts & Wallet Connection
You are responsible for maintaining the security of your connected wallet and account credentials. You agree to:
- Keep your wallet credentials secure and confidential
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
We are not responsible for losses resulting from compromised wallet credentials.
Donation Processing
All donations are processed in USDC stablecoin on the Base blockchain. By making a donation, you acknowledge:
- Donations are routed via smart contracts to campaign wallets
- Blockchain transactions are irreversible once confirmed
- You are making a voluntary political contribution
- Your contribution complies with FEC limits and regulations
Refunds: Refund requests must be submitted within 60 days and are subject to campaign approval and applicable regulations. Blockchain transaction fees are non-refundable.
FEC Compliance Obligations
Donors: You certify that your contribution is made from your own funds, not from a corporation, labor union, foreign national, or federal contractor. You understand contributions over $200 are publicly reported.
Candidates: You are solely responsible for your campaign's FEC compliance, including contribution limits, reporting, and disclaimers.
Prohibited Activities
You may not use PolyFund to:
- Make contributions in another person's name (straw donor contributions)
- Circumvent contribution limits through multiple accounts or identities
- Launder money or engage in fraudulent activities
- Make contributions from prohibited sources (corporations, unions, foreign nationals)
- Interfere with the platform's security or operations
- Violate any federal or state election laws
Violations may result in account termination and referral to law enforcement.
Intellectual Property
PolyFund and its content, features, and functionality are owned by PolyFund and protected by intellectual property laws. You may not copy, modify, or distribute our platform without written permission.
Limitation of Liability
PolyFund is provided "as is" without warranties of any kind. We are not liable for:
- Blockchain network issues, delays, or transaction failures
- Smart contract vulnerabilities beyond reasonable security measures
- Actions of campaigns, candidates, or other users
- Regulatory enforcement actions against users
- Indirect, incidental, or consequential damages
Our total liability is limited to the amount of fees paid to PolyFund.
Indemnification
You agree to indemnify and hold PolyFund harmless from any claims, damages, or expenses arising from your use of the platform, violation of these terms, or violation of any law or third-party rights.
Dispute Resolution
Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits.
Modifications
We may update these Terms of Service at any time. Continued use of PolyFund after changes constitutes acceptance of the modified terms. We will notify users of material changes via email or platform notification.
